A. Procedure for reporting intellectual property infringement

Our policy is to: (1) remove or disable access to content that we believe in good faith infringes the rights of others after receipt of a compliant notice, and (2) discontinue service to repeat infringers.

To submit a notice, email our Designated Agent with ALL of the following:

  1. Identification of the work or rights you claim are infringed (include any registration numbers if available).
  2. Identification of the specific content you claim is infringing, including: (a) a brief description of how it infringes, and (b) the exact location on our website so we can find it quickly (full URL or product link).
  3. Your contact details: full name, mailing address, phone number, and email address.
  4. A statement that you have a good faith belief the disputed use is not authorized by the rights holder, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on the rights holder’s behalf.
  6. Your physical or electronic signature.

B. Once a proper notice is received

  • We may remove or disable access to the identified material.
  • We will notify the content provider that the material was removed or access was disabled.
  • If the content provider is a repeat offender, we may terminate access to services.

C. Procedure to submit a counter notice (for the content provider)

If your material was removed and you believe it is not infringing, or that you have the right to use it (for example permission from the rights owner or use allowed by law such as fair use), you may submit a counter notice to our Designated Agent containing ALL of the following:

  1. Identification of the content that was removed or disabled and where it appeared on the site before removal.
  2. A statement, under penalty of perjury, that you have a good faith belief the content was removed or disabled due to mistake or misidentification.
  3. Your contact details: full name, mailing address, phone number, and email address.
  4. A statement that you consent to the jurisdiction of the Federal Court for the judicial district where your address is located.
  5. Your physical or electronic signature.

If we receive a valid counter notice, we may send a copy to the original complainant and inform them that we may restore the content in 10 business days. Unless the rights owner notifies us that they have filed a court action to restrain the alleged infringement, we may restore the content in 10 to 14 business days or more at our discretion.

Important notes

  • Under 17 U.S.C. Section 512(f), anyone who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
  • Submitting incomplete notices or counter notices can delay processing.
